Yes, i am serious, ive just had a threat to be sued by 2 companys, phenomenal designs inc and phenomenal designs llc

But besides the chit chat there's nothing to worry I think.
They just want to f*ck up with you because you use the same
name. I hope everything will go well. Did they only threat you
with emails? Cause if they did then you can simply apologize
in a very innocent way and change your name for ending it up
there so no threats reach the court!

its unforunate but they are within there rights

he is using a company name that they own rights to and making money from it, its very unfortunate but you'd best do what they say, legally you dont have a foot to stand on, they have the right to phenominal designs, i remember optix checked this stuff out before choosing DJ Optix, better do that in the future

Ok guys, i like your ideas and what not lol, although ive just been talking to one of my friends (Who happens to know alot about business) and they have not trademarked the name so they have no right to sue me, and i should trademark the name asap, but where do i trademark it?

wouldn't work, he wasn't around as long as them so they could use it against him. Also, it takes money to sue, a lot to sue a company. He's barely got enough to trademark the logo in the first place...

now if i was still in touch with my mums old friend i would ask here as she was a lawyer and negotiator she was responsible for making the comonwealth games in manchester profitable and she also is one of the main people whe sort stuff out for the liverpool capital of culture. so im pretty sure she would of been able to help but alas i havnt spoken to here in over 12 months.

1: trademark the name (there are many ways to do it)
2: sue... find a lawyer that takes percentage of outcome rather then fee + percentage

Id trademark right away though and I'd have to argue with you on the point before reaper since even if they have been around a while its not like there is name seniority not many people have probs heard of this company so i doubt they have powerful friends or anything so i dont see why phen wouldnt have a case if he trademarked and they refused to change.

also, the fact that it is an American Company, you would need to get a worldwide trademark...

I think when trademarking it is worldwide jsut registered under the corresponding country, failing that there may be a seperate trademarking method structured for the internet.
